The following Terms of Use shall apply to ZIMOBY website users on or after 1 June 2010 or from the date of first visit whichever is earlier. This policy tells you about your rights and limitations to the use of services provided on ZIMOBY website.

Collection

You can browse our sites without telling us who you are or revealing any personal information about yourself. However once you register on ZIMOBY  and give us your personal information, you are no longer anonymous to us. By registering at ZIMOBY, you consent to the transfer and storage of your registration information on our servers.

We may collect and store the following personal information:

·         email address, physical contact information, and (depending on the service used) sometimes financial information, such as VAT registration numbers; We do not collect or store secure and sensitive payment information such as credit card numbers, PINs, etc

·         information from other companies, such as demographic and navigation data;

Use

Appropriate Usage Policy

ZIMOBY maintains an appropriate usage policy that must be complied with by all users of its website to ensure the safety and satisfaction of all our members. The following prohibitions are guidelines and are not intended to be exhaustive.

·         Engaging in any activity that is prohibited by any applicable local, state, federal and international law or regulation

·         Acts that are considered as “419” and other offences that are punishable under the EFCC or the ICPC regulations

·         Use of the services in connection with attempts whether or not successful to violate the security of the website. Such violations include theft or infringement of personal information, members telephone numbers, credit cards including threats of physical harm or harassment, libel or defamation

·         Acts of hacking, cracking into, monitoring or using systems without authorization, scanning ports, conducting denial of service attacks, detabase injections and distributing viruses or other harmful content on the website.

·         Creating a false identity or product for the purpose of misleading others, especially when sending messages by sms

·         The use of ZIMOBY sites to post scams, phishing attacks, objectionable, offensive, obsene and/or pornographic content either as text messages or adverts considered a violation of the Appropropriate Usage Policy.

ZIMOBY reserves the right to terminate or suspend service to any member for violations of the AUP without any liability. ZIMOBY, at its sole discretion, will determine whether customer actions violate the AUP. Received Content

You, and not ZIMOBY, are entirely responsible for all content that you receive via the SMS service. You understand that all messages, texts, images, or any other materials posted on, transmitted through, or linked from the SMS Service, are the sole responsibility of the person from whom such content originated. You understand that ZIMOBY does not control, and is not responsible for content made available through the SMS Service, and that by using the SMS Service; you may be exposed to content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, the content available through the SMS Service may contain links to other websites, which are completely independent of ZIMOBY or the SMS Service. ZIMOBY makes no representation or warranty (express or implied) as to the accuracy, completeness or authenticity of the information contained on the SMS Service. You agree that you must evaluate, and bear all risks associated with, the use of any content, that you may not rely on said content, and that under no circumstances will ZIMOBY be liable in any way for any content or for any loss or damage of any kind incurred as a result of the use of any Content made available via the SMS Service. You acknowledge that ZIMOBY does not pre-screen or approve content, but that ZIMOBY shall have the right (but not the obligation) in its sole discretion to refuse, delete or remove any content that is available via the SMS Service or the Site, for violating the letter or spirit of these Terms and Conditions or for any other reason.

You understand that by using the SMS Service, you may be exposed to content that may be deemed offensive or objectionable as stated above. Under no circumstances will ZIMOBY be liable in any way for any content, including, but not limited to, errors or omissions of any content, loss or damage of any kind incurred as a result of the use of any content made available to you via the SMS Service.

We may amend this Terms of Use at any time with or without notice by posting the amended terms on this site. All amended terms automatically take effect from the date posted.
